1. Introduction

These Terms & Conditions govern your access to and use of InPlay.finance, including its website, applications, dashboards, alerts, tools and related services (the "Service").

InPlay.finance is operated by 1 JUMP 2 ("we", "us" or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree to them, you should not use InPlay.finance.

2. About InPlay.finance

InPlay.finance provides software and data tools designed to help users discover, monitor and analyse publicly traded securities.

Features may include:

  • stock discovery and market scanning;
  • In-Play and momentum indicators;
  • watchlists;
  • market alerts and notifications;
  • stock and market data;
  • trading journals;
  • analytics and historical information;
  • optional integrations with third-party services.

Features may be added, changed, removed or made available only to certain membership levels from time to time.

3. No Financial Advice

InPlay.finance does not provide financial, investment, trading, tax or legal advice.

Information provided through the Service, including alerts, scores, rankings, signals, indicators, market data and commentary, is provided for informational and educational purposes only.

Nothing on InPlay.finance constitutes a recommendation or invitation to buy, sell or hold any security or other financial instrument.

You remain solely responsible for your own trading and investment decisions. You should carry out your own research and, where appropriate, seek advice from a suitably qualified professional.

Trading and investing involve risk and you may lose some or all of the money you invest. Past performance is not a reliable indicator of future results.

4. Market Data and Alerts

Financial markets move quickly and information may become outdated within seconds.

Although we aim to provide useful and timely information, we do not guarantee that market data, prices, alerts, news, calculations, indicators or other information displayed through InPlay will always be complete, accurate, current or uninterrupted.

Delays, errors and outages may occur because of market conditions, internet connectivity, third-party data providers or technical issues outside our control.

You should independently verify information before relying on it for a trading or investment decision.

5. Eligibility

You must be at least 18 years old to create or use an InPlay.finance account.

By using the Service, you confirm that you are legally capable of entering into a binding agreement with us.

6. Your Account

You are responsible for maintaining the security of your InPlay account.

You agree to:

  • provide accurate and current information when creating your account;
  • keep your login credentials confidential;
  • not share your account with another person where this would breach your membership terms;
  • notify us if you believe your account has been accessed without permission;
  • take responsibility for activity carried out through your account.

You must not attempt to access another user's account or circumvent security, usage limits or access controls.

7. Memberships and Features

InPlay may offer free and paid membership levels.

The features, limits and prices associated with each plan are described on our Pricing page.

We may change the features included in a membership as the Service develops. Where a change materially affects an existing paid subscription, we will provide reasonable notice where appropriate.

8. Payments and Subscriptions

Payments for paid memberships are processed by Stripe or another payment provider identified at checkout.

If you purchase a recurring subscription, you authorise the payment provider to charge the applicable subscription fee at the frequency shown when you subscribe, until the subscription is cancelled.

Prices and billing periods will be shown before you complete a purchase.

9. Cancellation and Refunds

You may cancel a recurring subscription at any time using the account tools made available to you or by contacting us.

Unless otherwise stated, cancellation stops future renewal charges and your paid access may continue until the end of the period you have already paid for.

Refunds are not normally provided simply because you decide to stop using the Service part-way through a billing period.

Nothing in these Terms affects any cancellation, refund or other statutory rights you may have under applicable UK consumer law.

10. Third-Party Services and Integrations

InPlay may use or integrate with third-party services, including market-data providers, analytics services, payment processors and brokerage or trading platforms.

Examples may include Stripe, Google Analytics and Trading 212.

Third-party services are operated independently from InPlay.finance and are subject to their own terms, privacy policies, availability and technical limitations.

We are not responsible for the operation, availability, pricing, accuracy or actions of a third-party service.

If you choose to connect a third-party account to InPlay, you are responsible for ensuring that you are permitted to do so and for configuring the permissions associated with that account appropriately.

11. Acceptable Use

You must not use InPlay.finance to:

  • break any applicable law or regulation;
  • attempt to gain unauthorised access to our systems or another user's account;
  • interfere with or disrupt the Service;
  • probe, scan or test vulnerabilities without our permission;
  • introduce malware or malicious code;
  • scrape or systematically extract data in a manner that places unreasonable load on the Service;
  • resell, reproduce or commercially redistribute substantial parts of the Service without permission;
  • misrepresent your relationship with InPlay.finance or 1 JUMP 2.

12. Intellectual Property

InPlay.finance, its software, design, branding, original content, databases, graphics and related intellectual property are owned by 1 JUMP 2 or used under licence.

Your right to use the Service is personal, limited, non-exclusive and revocable.

These Terms do not transfer ownership of InPlay software, content or intellectual property to you.

13. Your Content

You retain ownership of information you add to InPlay, such as personal watchlists and trading journal entries.

You give us permission to process and store that information to the extent reasonably necessary to operate and provide the Service.

14. Availability of the Service

We aim to keep InPlay available and reliable but do not guarantee continuous or error-free access.

We may temporarily restrict access for maintenance, security, upgrades, technical problems or circumstances outside our reasonable control.

We may also modify or discontinue individual features as the platform develops.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any rights that cannot legally be excluded under consumer law.

Subject to those rights, InPlay.finance is a software and information service. We are not responsible for trading or investment losses resulting from decisions you make using information obtained through the Service.

In particular, we are not responsible for losses arising from:

  • changes in financial markets;
  • trading or investment decisions made by you;
  • delayed, unavailable or inaccurate third-party market data;
  • third-party platforms or integrations;
  • internet, network or device failures outside our reasonable control;
  • your failure to keep account credentials secure.

16. Suspension and Termination

We may suspend or restrict an account where reasonably necessary to protect InPlay, its users or our systems, or where we reasonably believe these Terms have been seriously or repeatedly breached.

We may terminate an account in cases of serious misuse, fraud, security abuse or unlawful activity.

You may stop using InPlay or request closure of your account at any time.

17. Privacy

Information about how we collect and use personal information is set out in our Privacy Policy.

18. Changes to These Terms

We may update these Terms as InPlay develops or where changes are required for legal, regulatory, security or operational reasons.

The latest version will be published on this page together with its revision date.

Where a change is material to an existing paid service, we will provide reasonable notice where appropriate.

19. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in this section removes any rights you may have to bring proceedings in another court where applicable consumer law gives you that right.
